Terms & Conditions

Last updated: October 2026

1. Scope

These Terms & Conditions govern all contracts between DISERVAR (“we”, “us”) and the client (“you”, “the client”) concerning the design, development, delivery and maintenance of websites and related additional services. Our services are directed exclusively at businesses, self-employed persons and commercial clients (B2B), not at consumers.

2. Contracting party & governing law

The contracting party is Chaya Kerdkumthong, DiWoS B2X, under the DISERVAR brand (address as stated in the Legal Notice). All contracts are governed exclusively by Thai law. The place of jurisdiction, as far as legally permitted, is Nakhon Si Thammarat, Thailand. Clients from Germany, the EU and other countries may place orders; in doing so, they knowingly enter into a contract with a provider based abroad.

3. Our services

We offer high-end, pre-designed website designs that we tailor to your brand (colors, corporate identity, content and images). This is not a website developed entirely from scratch, but a refined design that is professionally fitted to you. Every package includes:

Optional add-ons: SEO package €99, GEO package €248 (includes the full SEO package, not charged twice), each additional language €149. Individual special requests are agreed and charged separately.

Performance commitment: for our simple, static sites without heavy interactive elements (in particular the Landing and Business packages), we aim for a score of around 97 in the “Performance” category of Google's Lighthouse test at the time of acceptance, measured on the site as delivered by us under standard test conditions. Excluded are compute- or data-intensive content, in particular 3D experiences and cinematic video heroes (both offered as custom projects), as well as scripts, embeds, tracking or marketing tools, large unoptimized media and external services added later by the client or third parties; for such pages we optimize for smooth, stable playback rather than a particular numeric score. The Lighthouse score is a snapshot and may vary with the measuring device, network and changes made by Google; it does not constitute a permanent guarantee of an exact value.

4. Formation of the contract

First contact is made via our inquiry form. Based on your details we prepare an offer. The contract is formed when you accept the offer and pay the project price via the payment link (see clause 5). On request, we clarify scope and details beforehand in a personal conversation.

5. Prices & payment

All prices are in euros (€). Guide prices apply to the packages: The Landing from €299, The Business from €499, The Booking from €799. The binding price is stated in your quote. You pay the project price in full via a Stripe payment link.

Prices apply at the time of the offer and may change for future orders. Third-party services we obtain or commission on your behalf, e.g. domain and email, professional photography or video, paid tools, software or platform subscriptions and accounts (such as a booking system), paid fonts or plugins, are not included in the price unless expressly agreed. We agree them with you in advance, itemize them, and pass them on at cost. As they are paid to third parties or registered in your name, they become due once commissioned and are non-refundable.

If you end the project before acceptance, the work performed up to that point is payable by effort, as are any third-party costs already commissioned on your behalf; the amount already paid is offset against this. Neither party has any claim beyond that.

6. Client cooperation

So that we can work efficiently, you provide the necessary content and information and (where required) access credentials (e.g. to domain and email) in good time. For content, trademarks and images you supply, you warrant that you are entitled to use them. Delays on your side may push back the agreed schedule.

7. Revisions & acceptance

Every package includes three correction rounds. Further rounds are billed by effort, and we tell you the price first. Once finished, we provide the result for acceptance. Acceptance is deemed given when you confirm it, put the site into use, or do not report justified material defects within 14 days.

8. Care plan: requirement, term & cancellation

Every website requires a Care plan. It starts when the website goes live and has a minimum term of 24 months. After that it renews automatically for 12 months at a time unless you cancel in text form (e.g. by email) at least 3 months before the end of the current term. The Care fee is charged yearly in advance. Early termination during the term is excluded; the right to terminate for good cause remains unaffected.

9. Ongoing services (care plans)

Operation, hosting, security, backups and monitoring of your site are provided through the Care plan (Care · Static or Care · Managed, optionally with a booking system). Current prices are listed on our website and in your quote. When the Care plan ends, we take the website offline.

10. Rights of use

Your domain is registered in your name. Content you provide (texts, images, trademarks) remains yours. The website, its code and the design elements we create remain our property. For the duration of your Care plan you receive a simple right to use the website for your business. Handing the website over for self-hosting is not part of the service. Third-party components used (e.g. fonts, libraries, external services) are subject to their own licenses.

11. Hosting & availability

We host your site with a professional hosting provider and strive for high availability. We cannot guarantee uninterrupted, one-hundred-percent availability, in particular in the event of third-party outages, force majeure or necessary maintenance.

12. Warranty & liability

We provide our services with professional care. Material defects you report after acceptance will be remedied within the agreed scope. We give no guarantee of any particular ranking in search engines or AI systems, of revenue, or of the results of your business. Our liability is governed by Thai law; as far as legally permitted, it is limited to intent and gross negligence and capped at the value of the respective order.

13. Data protection

How we handle data is described in our Privacy Policy.

14. Final provisions

Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected. We may adapt these terms for future orders; for an ongoing order, the version agreed at the time the contract was formed applies. Thai law applies.
